Hello! Welcome to the Terms and Conditions section. These Terms and Conditions apply to the developments carried out with DigitalArts in the field of Social Networks. By accessing our products and services, you are agreeing to the terms detailed below.
DASM001 - Scope of terms and conditions
The present terms and conditions established indicate how DigitalArts uses and protects the information that is provided by its users when carrying out projects or registering services with us. These terms and conditions also apply to clients and/or strategic partners (partners) who work month to month together with us. DigitalArts. We are committed to the security of our users and customers' data. Below we will mention some aspects to consider when moving forward with us.
DASM002 - Visual Content Services
DigitalArts specializes in the generation, creation and management of visual content for social media. Our services include the design and development of reels, feeds and other graphic and audiovisual materials intended for promotion and dissemination on social media platforms.
DASM003 - Intellectual Property
All visual content created by DigitalArts, including reels, feeds, images, videos and any other material, is the exclusive property of the client. However, DigitalArts reserves the right to include the content created in its portfolio within its websites or as examples of work completed, always referring to the client/strategic partner with satisfaction for having completed or currently completing joint projects. DigitalArts will not express itself negatively towards the client or partner.
DASM004 - Confidentiality
All information provided by our clients, including login details for social media accounts and marketing strategies, will be treated confidentially and will not be shared with third parties without the client's express consent, unless we are required by law to do so.
DASM005 - Use of Generated Content
The visual content generated by DigitalArts for our clients will be used exclusively for the purpose of promoting it on social networks and digital platforms. We are not responsible for any improper or unauthorized use of the content by third parties. Furthermore, it should be noted that DigitalArts does not impose any type of restriction on the client or strategic partner for the use of the graphic pieces, that is, they can be used freely.
DASM006 - Payments and Terms of Contract
Payments for our services will be agreed between DigitalArts and the client and must be made in accordance with the terms set forth in the service agreement. The client agrees that the minimum duration of the contract will be six months, unless otherwise agreed in writing. Monthly payments must be made within the first 10 (ten) business days of each month in advance.
In the event that a confidentiality agreement is in force, DigitalArts will respect the agreed deadlines or events mentioned in this clause.
DASM007 - Password and Authentication Policy
In the event that the client or strategic partner provides passwords to access their social media accounts, these will be treated with the utmost security and confidentiality. It is suggested that the client or strategic partner implement a token and two-step authentication system to increase the security of the accounts and thus ensure ownership of them.
DASM008 - Use of Third Party Platforms
Third party platforms such as Buffer will be used to schedule and manage social media posts. The client agrees to the terms and conditions of said platforms and understands that DigitalArts is not responsible for the operation of external services.
DASM009 - Limited Liability
DigitalArts is committed to providing high-quality services in the generation, creation and management of visual content. However, we are not responsible for the performance of marketing campaigns or the results obtained on social networks.
DASM010 - Modification of Terms and Conditions
We reserve the right to modify these terms and conditions at any time should the need arise due to any update in third party or own policies. Any changes will be communicated to the customer by email, and continued use of our services after such modifications will constitute acceptance of the new terms and conditions.
DASM011 - Additional Content Requested
Any additional requests beyond the previously agreed scope will be subject to an additional cost, which will be agreed upon by both parties prior to execution. DigitalArts reserves the right to provide a detailed quote for any extra work requested and to adjust delivery times accordingly.
