Hello! Welcome to the Terms and Conditions section. These Terms and Conditions apply to the developments carried out with DigitalArts in the field of Social Networks. By accessing our products and services, you are agreeing to the terms detailed below.
DADV001 - Scope of the terms and conditions
The present terms and conditions established indicate how DigitalArts uses and protects the information that is provided by its users when carrying out projects or registering services with us. These terms and conditions also apply to clients and/or strategic partners (partners) who work month to month together with us. DigitalArts. We are committed to the security of our users and customers' data. Below we will mention some aspects to consider when moving forward with us.
DADV002 - Visual, 3D, UX and Multimedia Design Services
DigitalArts offers a wide range of services in visual design, user experience (UX), interface design (UI), 3D modeling and animation, as well as multimedia design. The specific scope of services will be detailed in the engagement agreement or proposal.
DADV003 - Intellectual Property
All designs, creations, images, graphics, 3D models and multimedia materials developed by DigitalArts for your project are the exclusive property of the client or partner, unless otherwise agreed by a specific contract. They may not be used for purposes other than the project without our prior written consent. However, DigitalArts reserves the right to present the material produced in brochures, events and websites associated with the brand.
DADV004 - Use of Generated Material
Materials created by DigitalArts are intended for the exclusive use of the client and the agreed project. The client or partner reserves the right to use the generated material without restrictions by DigitalArts.
However, preliminary designs that were not accepted by the client or partner are the exclusive intellectual property of DigitalArts, and these may not be used by the client.
DADV005 - Term Agreement
The estimated time for delivery of the work will be agreed with the client or partner at the beginning of the project. At Digitalarts, we are committed to meeting the agreed deadlines and maintaining fluid communication to inform you about the progress of the work.
DADV006 - Right of Publication
DigitalArts reserves the right to share the content developed for your project on our distribution channels, portfolio and social networks, always respecting the presentation of the brand and the project in question. This allows us to showcase our work and thank you for the trust placed in our creative team.
DigitalArts will not publish content that is in the development process or has not been presented by the brand in question to the general public.
In the event that a confidentiality agreement is in force, DigitalArts will respect the agreed deadlines or events mentioned in this clause.
DADV007 - Client Responsibilities
The Client is responsible for providing accurate and complete information necessary for the completion of the project. The Client also warrants that he or she has the necessary rights to use any material provided to DigitalArts, including text, images, videos or logos, and that he or she does not infringe the rights of any third party.
DADV008 - Project Cancellation
The client has the right to cancel the project at any time in writing. In the event of cancellation, the client will be required to pay for the services and work performed up to the date of cancellation.
DADV009 - Trademark and Applicable Law
DigitalArts is a registered trademark in the Argentine Republic, with headquarters in the city of Mar del Plata. These terms and conditions are governed by the laws of the Argentine Republic.
DADV010 - Jurisdiction
In the event of any dispute or controversy arising in relation to the services provided, both parties agree to submit to the jurisdiction of the ordinary courts with jurisdiction in the city of Mar del Plata, waiving any other jurisdiction that may apply to them.
DADV011 - Limitation of Liability
DigitalArts is not liable for any direct, indirect, incidental or consequential damages arising from the use of the services or the designs delivered.
